By accessing or using Pasco Cloud or Pasco SiteView (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
The Service is a construction management and surveying platform comprising Pasco Cloud and Pasco SiteView. Pasco Cloud provides tools for managing inspections, reports, issues, tasks, contracts, and project documentation. Pasco SiteView provides construction site surveying and measurement tools, including GPS and RTK GNSS positioning, design overlay viewing, and offline data capture and synchronisation. The Service includes web applications, mobile applications (iOS and Android), an administration panel, and associated tools. The Service is designed for construction professionals, contractors, project managers, and related industry participants.
3. User Accounts and Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activities under your account
4. User Content and Data
You retain ownership of all content, documents, and data you upload to the Service ("User Content"). By using the Service, you grant us a limited licence to store, process, and display your User Content solely for the purpose of providing the Service to you.
You are responsible for:
- The accuracy and legality of your User Content
- Ensuring you have rights to upload and share your User Content
- Backing up important data
- Complying with applicable laws regarding data privacy and security
- When using Pasco SiteView: verifying critical measurements independently — the application is a field reference tool and should not be used as a substitute for professional survey services where certified accuracy is required
- Maintaining appropriate licences and permissions for any CORS/NTRIP correction services you connect to via Pasco SiteView
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Upload malicious software or harmful content
- Attempt to gain unauthorised access to the Service or other users' data
- Interfere with or disrupt the Service
- Use the Service for any illegal or fraudulent purposes
- Share false or misleading information
6. Professional Disclaimers
Important: Pasco Cloud is a management tool and does not provide professional construction, engineering, legal, or safety advice. You acknowledge that:
- The Service does not replace professional judgment or expertise
- You are responsible for compliance with all applicable building codes, safety regulations, and laws
- Construction projects involve inherent risks that must be managed by qualified professionals
- We do not warrant the accuracy of any construction-related calculations or recommendations
- Measurement accuracy in Pasco SiteView depends on the GPS/GNSS equipment used and environmental conditions. The application displays accuracy estimates but does not guarantee measurement precision. Users should verify critical measurements independently
7. Privacy and Data Security
We take data security seriously and implement reasonable measures to protect your information. However, no online service can guarantee complete security. Our Privacy Policy, which is incorporated into these Terms, describes how we collect, use, and protect your information.
8. Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability
To the maximum extent permitted by law, Pasco Cloud and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Construction delays or project failures
- Data loss or corruption
- Business interruption
- Lost profits or opportunities
- Safety incidents or accidents
10. Indemnification
You agree to indemnify and hold harmless Pasco Cloud from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
11. Termination
Either party may terminate your account at any time. Upon termination, your access to the Service will cease, and we may delete your User Content after a reasonable notice period.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia without regard to conflict of law principles.
